In penal institutions there has been created an illegal and adverse situation by the decree that from January 1 prisons will house not only 11 000 convicts sentenced validly but they must give a home to five thousand suspects, too. Penal institutions must receive persons placed in pre-trial detention instead of police holding cells for humanitarian purposes prescribed by EU standards not to be thrown at the mercy of the police.
So the capacity of the prisons are used in an enormous way cramming prisoners 45 pc more than their total capacity so the county penal institutions are unable to give room even for visiting hours by the lawyers. A lawyer travelling some hundred kilometers is able to consult his or her defendant only after some days of waiting though the state is obliged to ensure the right of a suspect to prepare for the trial.
